A recent employment tribunal has ruled that an employee can make a whistleblowing claim against their current employer based on a previously protected disclosure that was made during their previous employment.
Disclosures are deemed protected if: there has been a breach of legislation, it has been formally reported, the facts are believed to be true and the disclosure was made in good faith.
A claim for 'unfair dismissal' can be made by the employee, if the main reason for their dismissal was their protected disclosure. This can be done without having worked a full 12 months service.
