As from 6th April 2009 SDDP will be replaced with the ACAS Statutory Code of Practice for disciplinary and grievance procedures.
Some of the changes;
· A dismissal will no longer be classed as ‘automatically unfair’ if the employer breaches procedure.
· Three month extension to raise a tribunal claim has been removed.
· Employees will be permitted to take a claim to the employment tribunal without having to raise a grievance with their employer first.
· Employment tribunals will be able to increase compensation by up to 25% where there has been unreasonable failure to follow the ACAS Code of Practice.
· Employers are encourage to resolve issues informal e.g. through mediation.
Employees are to be training in the new procedures.
